Terms and Conditions

§ 1 Scope

(1) These General Terms and Conditions apply to all contracts between Pavel Kirchmeier, Uhlandstraße 40, 73441 Bopfingen (hereinafter referred to as "Seller") and consumers or entrepreneurs (hereinafter referred to as "Customers") concluded via the online shop kirchmeier-reifen.de.

(2) Deviating conditions of the Customer are not recognized, unless the Seller expressly agrees to their validity in writing.

§ 2 Conclusion of Contract

(1) The product presentations in the online shop do not constitute a legally binding offer, but rather an invitation to place an order.

(2) By submitting the order in the online shop, the Customer makes a binding offer to conclude a contract. The contract is concluded when the Seller accepts the offer by order confirmation via email or by delivery of the goods.

(3) The contract text will be saved. The order data and order confirmation will be sent to the Customer by email.

§ 3 Prices and Payment Terms

(1) All prices are final prices in Euros and include the statutory value-added tax. Shipping costs will be added, which are displayed in the order process before the order is completed.

(2) Payment is made at the Customer's choice via the payment methods offered in the order process (e.g., PayPal, credit card, Klarna).

§ 4 Delivery Conditions

(1) Delivery is made to the delivery address provided by the Customer, usually by freight forwarding for wheels.

(2) Delivery times are stated on the product page or in the order process. Fixed delivery periods begin with the conclusion of the contract.

(3) If the delivery address provided by the Customer is not reachable or if the Customer refuses acceptance, the Customer bears the resulting additional costs.

§ 5 Retention of Title

The delivered goods remain the property of the Seller until full payment of the purchase price.

§ 6 Liability for Defects (Warranty)

The statutory liability for defects applies. The limitation period for claims for defects is two years from the delivery of the goods.

§ 7 Applicable Law and Jurisdiction

(1) German law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as the protection granted thereby is not withdrawn by mandatory provisions of the law of the state in which the consumer has his habitual residence.

(2) If the Customer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction is the Seller's registered office.
